Terms & Conditions – Vitamia Limited trading as Vitamia Health

1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Vitamia Health website (vitamiahealth.com) and the purchase of any products from Vitamia Limited trading as Vitamia Health (“Vitamia Health”, “we”, “us”, or “our”). By accessing our Site or placing an order, you agree to these Terms along with our Privacy Policy and Returns & Delivery Policy.

Vitamia Limited trading as Vitamia Health is a company registered in England and Wales [OC16351637]. All references to 'we' or 'our' in these Terms refer to Vitamia Limited trading as Vitamia Health.

3. Eligibility

You must be at least 18 years old to purchase from us. By placing an order, you confirm that all information provided is accurate, complete, and authorized.

4. Contract Formation

Your order constitutes an offer to purchase. Acceptance occurs when we email you an order confirmation. If we cannot accept your order (e.g., due to stock or pricing errors), we will notify you and refund any payment.

5. Products & Availability

All products are subject to availability. Product images are for illustrative purposes and may differ slightly from the actual product. We may withdraw or amend products without notice.

6. Pricing & Payment

Prices are in GBP (£) and include VAT where applicable. We reserve the right to change prices without prior notice. Full payment is required at the time of order using the accepted methods on our Site.

7. Subscriptions

Some products are available on a subscription basis. Subscriptions renew automatically until cancelled. You can manage, pause, or cancel subscriptions via your account. We may update subscription pricing with prior notice, usually 7 days. You have the right to cancel your subscription at any time.

8. Delivery

We deliver within the UK and to selected international destinations. Delivery times are estimates only. Risk passes upon delivery; ownership passes once full payment is received.

9. Right to Cancel

Under the Consumer Contracts Regulations, you have the right to cancel your order within 14 days of delivery for a refund. Products must be unopened and in original condition. Please see our Returns & Delivery Policy for details.

10. Returns & Refunds

If products are faulty or damaged, you may return them for a refund or replacement. Refunds will be process within 14 days of receiving unopened goods. Please contact us at hello@vitamiahealth.com for instructions.

11. User Accounts

You are responsible for maintaining the confidentiality of your account details and for all activities under your account. Notify us immediately of any unauthorized use.

12. Intellectual Property

All content, trademarks, and materials on our Site are owned by or licensed to Vitamia Health. You may not reproduce or exploit them without permission.

13. Prohibited Uses

You may not use our Site or products for unlawful, harmful, abusive, or fraudulent purposes, including but not limited to spamming, uploading malicious code, or infringing intellectual property rights.

14. Medical Disclaimer

Our products are dietary supplements. They are not intended to diagnose, treat, cure, or prevent disease. Always consult a healthcare professional before use, particularly if you are pregnant, breastfeeding, under 18, or taking medication.

15. Limitation of Liability

We are not liable for indirect or consequential losses arising from the use of our Site or products, except where required by law. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other rights that cannot be excluded under UK law.

We are not responsible for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by events beyond our reasonable control. Such events may include (but are not limited to) natural disasters, fire, flood, adverse weather, strikes, labour disputes, war, acts of terrorism, epidemics or pandemics (including government-imposed restrictions and supply chain disruption), changes in law or regulation, courier delays, or failures of public or private telecommunications networks or utilities.

Where a Force Majeure event occurs, we will take reasonable steps to minimize its impact and will keep you informed as soon as reasonably possible.

These Terms are governed by English law. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
